Property Licensing

The Property, Stock and Business Agents Act 2002 (the Act), regulates the licensing of people working within the property and real estate industries. There are six distinct licence categories in NSW:

In addition to NSW Property Licence qualifications, the Australian College of Professionals is approved to conduct the prescribed Estate Agent course for Victoria as well as the Real Estate Licence qualifications for Qld and the ACT.

For each of the categories of licence above, you must successfully complete the relevant Certificate IV in Property Services level qualification which covers the competencies required by NSW Fair Trading to grant your licence in that category.

Government Funded Training:

Government Funding is available for these courses for eligible employees under our Traineeships program. For further information download our Traineeship Information Package or please contact us on 1300 88 48 10.

Other Property Licenses
Other types of license qualifications offered by the College include:

This licence is an alternative to general real estate sales and looks at working solely for the purchaser and acting on their behalf throughout the sales process.

People who have completed the qualifications for this licence will be eligible for some exemptions towards the the Real Estate Licence qualification.

This licence involves the purchase of management rights.  You must be nominated on the Contract of Sale for one of the lots in the complex, as either an individual or as a Director of a Company who is purchasing the overall management rights.  You must also live on-site to be eligible to apply for an On-Site Residential Property Managers licence.

This licence enables the licence holder to carry on business as an agent for:

  1. giving possession of residential premises under a lease, licence or other contract or arrangement, or
  2. collecting bonds, deposits, rents, fees or other charges in connection with any such lease, licence or other contract or arrangement. (Section 3 of the Property, Stock and Business Agents Act 2002).

Licence Eligibility

In addition to the required qualifications, NSW Fair Trading has additional eligibility requirements before granting a licence and applicants must satisfy the Commissioner for Fair Trading that he/she is:

  • At least 18 years of age
  • A fit and proper person to hold a licence. Any person in partnership with a licensee in a property agency must also be a fit and proper person
  • Has the required competencies for the licence
  • Is not a disqualified person
  • Has paid the relevant contribution to the Property Services Compensation Fund

Recognition of Prior Learning (RPL)
